1. Agreement Overview

This User Agreement (hereinafter referred to as the "Agreement") is a legally binding contract between you (hereinafter referred to as the "User") and the operator of the Folen application (hereinafter referred to as "we", "us", or "our"). This Agreement governs your access to and use of the Folen software application (hereinafter referred to as the "App"), including all its core functions, service features, and related content services.

By downloading, installing, accessing, or using the Folen App, you fully acknowledge, understand, and unconditionally agree to abide by all the terms and conditions stipulated in this Agreement. If you do not agree to any part of this Agreement, you shall immediately stop all access and use of the App.

2. Age Eligibility Restriction

The Folen App is strictly designed and provided for use by individuals who are 18 years of age or older. We do not permit use of this App by minors under the age of 18.

You hereby confirm and warrant that you are an adult aged 18 or above with full civil capacity to enter into this legally binding Agreement. If you are under the age of 18, you must not download, install, register for, or use any functions of the App. We reserve the right to verify user age information at any time and to permanently restrict or terminate the service qualification of any user who is confirmed to be underage.

3. Service Description

Folen is a landscape check-in diary application. The core services we provide include allowing users to upload landscape-related photos, edit and publish text diary content, complete landscape check-in operations, and generate exclusive personal landscape check-in diaries. All services provided by the App are for users' personal non-commercial entertainment and record-keeping purposes only.

We reserve the right to optimize, adjust, upgrade, or maintain the App's functions, interface, and service content at any time without prior notice to users, provided that such adjustments do not materially impair the basic legitimate rights and interests of existing users.

4. User Account and Use Rules

4.1 Users shall be solely responsible for the authenticity, legality, and validity of all information and content uploaded, published, and recorded through the App, including but not limited to landscape photos, text diaries, and other personalized content.

4.2 You agree not to use the Folen App to engage in any illegal, infringing, obscene, violent, defamatory, or other improper behaviors. You shall not upload, publish, or disseminate any content that violates national laws, regulations, public order, and good customs, infringes on the intellectual property rights, portrait rights, privacy rights, and other legitimate rights and interests of third parties.

4.3 You shall not use the App for commercial promotion, advertising, spam dissemination, data crawling, malicious attacks, or any other non-personal private use purposes. Any unauthorized commercial use is strictly prohibited.

4.4 We have the right to review, restrict, delete, or shield user content that violates this Agreement or relevant laws and regulations, and reserve the right to suspend or terminate the user's use qualification in case of serious violations.

5. Intellectual Property Rights

5.1 All intellectual property rights of the Folen App, including but not limited to software copyright, trademark rights, patent rights, text design, interface design, program code, and functional framework, belong exclusively to us. No user or third party may copy, reproduce, modify, distribute, sell, or use the above intellectual property rights without our written authorization.

5.2 Users retain the personal ownership of the original landscape photos and diary text content independently created and uploaded by themselves. However, you hereby grant us a non-exclusive, worldwide, free, perpetual, and usable license to use your uploaded content, including but not limited to displaying, storing, optimizing, and presenting the content within the App, for the sole purpose of providing you with normal App services.

5.3 Users shall ensure that all uploaded content is original and does not infringe any third-party rights. You shall bear full legal responsibility for any infringement disputes arising from user-uploaded content, and shall compensate us for all losses incurred thereby.

6. Privacy Protection

Your use of the App is also subject to our Privacy Policy. We will strictly protect your personal information and privacy security in accordance with relevant laws, regulations and privacy policy provisions, and will not disclose, sell or leak your personal information to third parties without your explicit consent, except as required by law.

7. Disclaimer of Liability

7.1 The Folen App provides services on an "as is" and "as available" basis. We do not make any express or implied warranties for the continuity, accuracy, completeness, and fault-free nature of the App's services.

7.2 We shall not be liable for any personal or property losses caused by user's improper operation, unauthorized use, network failure, equipment failure, or third-party behaviors.

7.3 We are not responsible for any disputes, losses, or legal liabilities arising from the content independently uploaded and published by users, and all relevant liabilities shall be borne by the users themselves.

8. Agreement Modification and Termination

8.1 We reserve the right to modify and update the terms of this Agreement in accordance with business adjustments and legal requirements. The updated Agreement will be published on the App interface and take effect immediately upon publication. Your continued use of the App after the update is deemed as acceptance of the revised Agreement.

8.2 We may terminate or suspend your right to use the App at any time if you violate any terms of this Agreement, engage in illegal acts, or seriously damage platform interests.

9. Governing Law and Dispute Resolution

This Agreement is governed by and construed in accordance with the relevant laws. Any disputes arising from the use of this App shall be settled through friendly negotiation between both parties; if the negotiation fails, either party may submit the dispute to the competent people's court for resolution.
